We collect the following personal information to allow us to communicate with you and/or your next of kin about your plot.

The holder of right accepts that Hutt City Council may disclose the first and last name of the holder of right to individuals making legitimate enquiries for the purpose of seeking permission to undertake work on the plot. This may include, but is not limited to, funeral directors, stonemasons, or family members. Hutt City Council will not disclose any contact details of the holder of right.

We also collect the following information about who the plot is intended for so we can match a future interment booking with your eased plot.

  • Name of person(s) intended to be buried

  • Date of birth of person(s) intended to be buried

Your information will be stored in accordance with the Hutt City Council privacy policy.

Terms and Conditions of a Plot Lease Agreement

The parties executing this application agree that:

  • The Hutt City Council Bylaw 1997 and the Burial and Cremation Act 1964 give Council provision to manage cemeteries. The Bylaw should be referred to for detail about the regulations associated with cemeteries owned by the Hutt City Council. Council policy guides presentation and day to day management.

  • Full and accurate details have been provided by the parties.

  • In the event that they wish to surrender any Plot Lease Agreement issued to them by the Council, providing that the Plot remains unused, the Council Cemetery asset manger may agree to refund not more than the original fee charged when the lease agreement was issued.

  • In the event that any person other than one of the persons named as having the right of interment conferred by a Plot Lease Agreement seeks interment in that Plot, then the Cemetery asset manager may refuse to allow interment in that Plot.

  • In the event that they wish to transfer their Right of Interment conferred by a Plot Lease Agreement to another person the parties must apply for the rights to be transferred by executing an "Application to Vary an Existing Plot Lease Agreement" in the form required by the Council.

  • Non-complying grave decorations are not permitted and will be removed without notice, by Council or it's contractor.

  • The holder of right accepts that Hutt City Council may disclose the first and last name of the holder of right to individuals making legitimate enquiries for the purpose of seeking permission to undertake work on the plot. This may include, but is not limited to, funeral directors, stonemasons, or family members. Hutt City Council will not disclose any contact details of the holder of right.

  • The holder of right and any other person or persons nominated in writing by the holder of right or his /her representative shall have the exclusive rights to use the land as an interment place as identified above.

  • No grave shall be dug and no monument or tombstone shall be erected or placed without the written approval of The Council following a headstone permit being applied for by the family or stonemason on behalf of the family, however cleaning and repainting do not require a permit. The council reserves the right request the removal of any monument or headstone that has been installed without approval or that does not meet compliance.

  • Any monument or tombstone made, dug, erected or placed pursuant to this grant shall be maintained and kept up by the holder of right or his/her representative or any person having the Right of Interment pursuant to this grant in proper condition and repair as determined by The Council. The council reserves the right to alter or remove headstones at their discretion for health and safety purposes only.

  • The exclusive Right of Interment is granted in perpetuity once the right is exercised. The right of interment means the holder of right owns the rights to use this plot, the land ownership still sits with The Council, meaning therefore that The Council bylaw and policies still apply to this land.

  • As the cemeteries are a public space the Hutt City Council are not liable for any headstone or plaque damage that occurs, unless specifically proven to be caused by the Hutt City Council.

  • These conditions set out are governed firstly by government legislation and secondly by Councils management plan and associated bylaws.

In the event that the plot nominated in a Plot Lease Agreement is no longer available or useable for any reason the Council shall provide an alternate plot without further cost.
